Terms and Conditions
§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders placed by consumers (§ 13 BGB) or entrepreneurs (§ 14 BGB) via the online shop "Vostok-World24" of the provider Natalia Arms, Bansiner Straße 25, 12619 Berlin (hereinafter "Seller").
(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
(3) These GTC also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.
§ 2 Conclusion of Contract
(1) The product presentations in the online shop serve to submit a purchase offer. They do not constitute a legally binding offer by the seller but an invitation to the customer to place an order (invitation to order).
(2) The customer can select products from the seller's range and collect them in a so-called shopping cart via the "Add to Cart" button. By clicking the "Order with obligation to pay" button, the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the customer can change and view the data at any time.
(3) The seller then sends the customer an automatic confirmation of receipt by e-mail, in which the customer's order is listed again and which the customer can print out using the "Print" function. The automatic confirmation of receipt only documents that the customer's order has been received by the seller and does not constitute acceptance of the offer. The contract is only concluded by the seller's declaration of acceptance, which is made by a separate e-mail (order confirmation or shipping confirmation) or by delivery of the goods.
(4) If payment is made by prepayment (manual bank transfer) or via an instant payment method (credit card, Klarna Sofort, PayPal, Apple Pay, Google Pay, Shop Pay), the contract is concluded upon the customer's payment instruction.
§ 3 Prices and Payment Terms
(1) The prices stated in the online shop are final prices. Due to the application of the small business regulation according to § 19 UStG, no value-added tax is charged or shown.
(2) The prices applicable at the time of the order apply. Delivery and shipping costs are shown separately.
(3) Payment can be made either via the methods offered by Shopify Payments or by manual bank transfer. Available payment methods include, among others:

Prepayment / Manual Bank Transfer: When selecting this payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
(4) The seller reserves the right to exclude certain payment methods in individual cases.
(5) When paying by credit card or other instant payment methods, your account will be charged upon completion of the order.
§ 4 Delivery Conditions and Shipping Costs
(1) Delivery is made to the delivery address provided by the customer.
(2) Information on shipping costs and delivery areas can be found in our separate shipping conditions. These are part of this contract.
(3) Unless another period is specified in the respective offer, delivery of goods within Germany takes place within 1-3 working days, and for international deliveries within 3-5 working days after conclusion of the contract (in case of agreed prepayment after the time of your payment instruction). Please note that no delivery takes place on Sundays and public holidays.
(4) If an ordered product is not deliverable on time because we were not supplied by our supplier in time, we will inform you immediately. In such a case, you have the right to wait for the ordered product or to cancel your order. In case of cancellation, any services already rendered will be refunded immediately.
§ 5 Retention of Title
The goods remain the property of the seller until full payment has been made. Before the transfer of ownership, pledging, security transfer, processing, or alteration without the seller's consent is not permitted.
§ 6 Right of Withdrawal
Consumers generally have a statutory right of withdrawal. Further information on the right of withdrawal can be found in the seller's separate withdrawal instructions.
§ 7 Transport Damage
(1) If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay.
(2) Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.
§ 8 Warranty
(1) The statutory warranty rights apply.
(2) The seller is liable for defects according to the applicable statutory provisions, in particular §§ 434 ff. BGB. For entrepreneurs, the warranty period for goods delivered by us is 12 months.
§ 9 Liability
(1) We are fully liable for damages resulting from injury to life, body, or health that are based on intentional or negligent breach of duty by us or our legal representatives or vicarious agents.
(2) Furthermore, we are fully liable for other damages resulting from intentional or grossly negligent breach of duty by us or our legal representatives or vicarious agents, as well as for damages under the Product Liability Act or from the breach of a guarantee.
(3) For damages resulting from the breach of an essential contractual obligation (cardinal obligation), the seller is liable in case of slight negligence limited to the typical, foreseeable damage. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner regularly relies.
(4) Otherwise, liability is excluded.
§ 10 Data Protection
Information on the collection, processing, and use of personal data can be found in our privacy policy.
§ 11 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG). If you are a consumer and have your habitual residence in another country at the time of your order, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seller's place of business (Berlin).
(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The relevant statutory provisions shall apply instead of the invalid provision. This also applies in the case of a contractual gap.
